The Checkout 51 Get Up And Go Sweepstakes

Eligibility: Sweepstakes is offered only in the 50 states of the United States and the District of Columbia and is open only to legal U.S. residents who are at least 18 (or age of majority in jurisdiction of residence, whichever is older), as of date of entry. Employees, officers and directors and their immediate family members (spouse or biological, foster, adoptive, or step-mother, father, sister, brother, daughter or son and each of their respective spouses, whether actual or purported) wherever they may live and others living in their same household (whether related or not) of Sponsor, its parent company, subsidiaries, affiliates, suppliers, agencies or of any entity involved in the development, production, implementation or offering of the Checkout 51 App ("App") and/or this Sweepstakes are not eligible to enter the Sweepstakes or win the prize. Sweepstakes begins on July 2 2015 at 12:01 a.m. local time and ends on August 5 2015 at 11:59 p.m. local time ("Sweepstakes Period"). Void in Puerto Rico; void where prohibited by law.

By participating, entrants accept and agree to abide by and be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects and not subject to appeal.

1. To Enter.

   1. Via App. Using the App, upload a dated, store-identified cash register receipt which shows the purchase of grocery products or gasoline and you will automatically receive one (1) entry in the Sweepstakes. For purposes of the Sweepstakes, "grocery products" consist of food, beverages (non-alcoholic), cleaning, washing, non-prescription (i.e., over-the-counter) pharmacy items, and/or personal care items. Gasoline includes any type of fuel used to fill up a vehicle at any gas station Checkout 51 offers on other products also qualify. To qualify for entry, all purchases must appear on the same receipt, and have been made in a single transaction at one (1) retail store.

      If you do not have the App: you may download the App for free on your Apple® or Android™ device**; or, use the App on your desktop computer at www.checkout51.com. To use the App, you must first become a Checkout 51 member: membership is also free.

   2. NO PURCHASE NECESSARY. To enter without purchase, send an email message to sweepstakes@checkout51.com with CHECKOUT 51 GET UP AND GO SWEEPSTAKES in the subject line and your name, gender, and a description of a trip you plan to take this summer in 150 words or less.

2. Entry Restrictions.

   All entries must be received by end of Sweepstakes Period (as defined above). Receipt of entries may be acknowledged, but such acknowledgment does not constitute any representation as to Sweepstakes eligibility. LIMIT ONE (1) ENTRY PER PERSON PER WEEK (A "WEEK" IS THURSDAY TO WEDNESDAY) REGARDLESS OF ENTRY METHOD USED. Any person who attempts to enter multiple times per week by using any device or artifice will be disqualified. Entries generated by script, macro, robotic, programmed or like means are prohibited and are void. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the Authorized Account Holder of the e-mail account associated with Checkout 51 membership (for entry via Rule 1a) or from which the entry is submitted (for entry via Rule 1b) as of date of entry. Authorized Account Holder will be determined by Sponsor in its sole discretion. Message and data rates may apply to use of mobile device for Sweepstakes entry. Be sure to check your wireless carrier's pricing plan before entering via mobile device.

3. Random Drawing.

   The winner will be selected via random drawing by Sponsor from among all eligible entries received during the Sweepstakes Period. The drawing will be held on or about seven (7) business days after end of Sweepstakes Period. Winner will be notified by e-mail and will be required to sign and return a Declaration of Eligibility, a Liability Release and a Publicity Release (where legal) within (7) calendar days of date of prize notification. In the event of noncompliance or if winner cannot be contacted for any reason (including failure in transmission of e-mail), the prize will be forfeited and an alternate winner selected from among all remaining eligible entries received for the drawing.

4. Prize/Odds of Winning.

   One (1) Prize – $1,000 (awarded as a check).

   Odds of winning depend on the total number of eligible entries received.

   No prize substitution. Prize is not transferable. Any expenses related to acceptance and use of prize as well as taxes on prize (if any) are winner's sole responsibility.

5. Additional Conditions of Participation.

   By accepting prize, except where prohibited by law, winner agrees to the use of his/her name, address (city, state), likeness, photograph, other indicia of persona and/or statements made by winner regarding the prize, the Sweepstakes or the Sponsor for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or notice. By participating, entrant indemnifies, releases and agrees to hold harmless Checkout 51 Inc., its parent company, subsidiaries, affiliates, suppliers, agencies, and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations, as well as Facebook, from any and all liability arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of the prize. Sponsor reserves the right, at its sole discretion, to disqualify from the Sweepstakes any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes, the App or any web site; to be acting in violation of the Official Rules or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights. Such other actions may include but are not limited to prohibition from participation in future sweepstakes and other promotions offered by Sponsor and/or revocation of Checkout 51 membership (if applicable).

6. Limitations of Liability.

   Sponsor's computer is the official clock for purposes of the Sweepstakes. Sponsor assumes no responsibility for (a) any incomplete, incorrect or inaccurate information, whether caused by web site or App users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the App, any web site, receipts and/or entries (including failure of an uploaded receipt to result in entry even if otherwise valid); and (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail transmission on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, or for injury or damage to entrant's or to any person's computer or mobile device (or any information/materials stored therein) related to or resulting from downloading/uploading materials from/to the App, any web site or participating in the Sweepstakes. Sponsor also assumes no responsibility for late, lost, illegible/garbled, incomplete, damaged, inaccessible, corrupted or jumbled e-mail transmissions, receipts or entries, regardless of cause; and, all of the foregoing are void.

   Force Majeure. If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes and select the prize winner from among all eligible entries received prior to the action taken by Sponsor or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on www.checkout51.com.

7. Privacy Notice.

   By entering the Sweepstakes, you consent to the collection of personal information by Sponsor in conjunction with such participation. Sponsor will only use that personal information for purposes of the administration of the Sweepstakes and in accordance with Sponsor's privacy policy which is accessible at www.checkout51.com/privacy.

8. Dispute Resolution/Governing Law.

   To the fullest extent permitted by law, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any entrant and/or Sponsor shall be filed in the courts of the Province of Ontario, CANADA, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action (and waive any right to change of venue, forum non conveniens, or any like right); (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any entrant and/or Sponsor, shall be resolved individually, without resort to any form of class action, and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (d) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and/or Sponsor, shall be governed by and construed in accordance with the laws of the Province of Ontario, CANADA without giving effect or regard to any principles or doctrines of conflicts of law/choice of law of the Province of Ontario, CANADA or of any other jurisdiction.

Requests must be received no later than two (2) business days after end of Sweepstakes Period at 9:00 a.m. (local time).
